Buying Properties In Spain
It is estimated that in the past decade 90,000 illegal buildings have
been erected in the "Costa Blanca" and "Costa del Azahar" coast, of which a
significant amount face Court decisions as to whether they will be demolished or
legalised. Most were bought by Britons who had no idea they were built
illegally. They made the fatal assumtion that full planning permission was
originally granted, only to find out that their new home was completely
illegal.
The reality is that planning permission in Spain is quite
different to the Uk and many other countries. Many builders just buy the
land, build the house and know that, in due course, after three or four years,
retrospective planning permission will be granted. It may or may not be
possible to get them legalised. This, and the amount of time and money required
to do so, will depen on the local council. While thay are still not officially
"urban", they may be vulnerable to demolition or "land grab".
A new version of the former draconian " Land grab" LRAU has
been recently aproved know as LUV.( which only applies to the Valencian
Community, i.e. The province of Alicante, valencia and castellón). Nevertheless,
this new land law is still contested in the European Parliament because it
leaves plenty of scope for abuse. Because private developers are usually
appointed as an "urbanising agent" by the Town Hall, they can act with legal
powers to compel the owners to cede land and make compulsory payments in
infraestructure charges ( drains, road access,etc) in order to enable this
"rustica" rural land to be reclassified and developed as "urban"
land. Therefore this law does not affect however anyone with an interest in
an area already urbanised, for instance apartments or townhouses.
Being unfamiliar with title deed procedures can make buying
